Victorian Planning Overlays Explained

In addition to planning zones, your property may be affected by one or more overlays. Overlays add extra planning requirements on top of the zone controls. They typically address specific issues such as heritage protection, environmental significance, flood risk, bushfire risk, or built form outcomes.

A property can have multiple overlays applying simultaneously. To check which overlays affect your property, search your address on VicPlan.

Heritage & Built Form Overlays

Clause 43

These overlays manage the design and character of buildings and protect heritage places. They are among the most common overlays in established suburbs.

HO

Heritage Overlay

Clause 43.01

Protects places of heritage significance including individual buildings, precincts, trees, and gardens. One of the most common overlays in inner and middle Melbourne suburbs.

When you may need a planning permit:

  • Demolishing or removing a building
  • Constructing or externally altering a building
  • Constructing or carrying out works including fences, paving, and landscaping
  • Removing or lopping a tree (if specified in the schedule)
  • Subdividing land
  • Displaying signage
DDO

Design and Development Overlay

Clause 43.02

Controls the built form outcomes in areas requiring specific design responses. Commonly sets building height limits, setbacks, and design objectives for activity centres and sensitive interfaces.

When you may need a planning permit:

  • Constructing or carrying out works (unless exempt under the schedule)
  • Building height, setback, or design standards set by the schedule
  • Specific design objectives that must be met
NCO

Neighbourhood Character Overlay

Clause 43.05

Identifies areas where the existing neighbourhood character must be protected through specific design responses. Complements ResCode requirements.

When you may need a planning permit:

  • Constructing or extending a building
  • Character objectives specific to the area must be considered
  • May include vegetation protection provisions
BFO

Built Form Overlay

Clause 43.06

A newer overlay providing detailed built form controls including height, setbacks, and design standards. Often used in activity centres.

When you may need a planning permit:

  • Building or works that do not meet the specified standards
  • Mandatory or discretionary height and setback requirements
IPO

Incorporated Plan Overlay

Clause 43.03

Requires development to be in accordance with an incorporated plan, commonly used for large sites with master plans.

When you may need a planning permit:

  • Development not in accordance with the incorporated plan
  • Variations to the plan require planning permission
DPO

Development Plan Overlay

Clause 43.04

Requires a development plan to be prepared before development can proceed. Ensures coordinated development of larger areas.

When you may need a planning permit:

  • Development before a plan is approved to the satisfaction of the responsible authority
  • Development not in accordance with the approved plan

Environmental & Landscape Overlays

Clause 42

These overlays protect significant natural features including vegetation, landscapes, and environmental values.

ESO

Environmental Significance Overlay

Clause 42.01

Protects areas with significant environmental values including native vegetation, waterways, and ecological habitats.

When you may need a planning permit:

  • Constructing or carrying out works
  • Removing, destroying, or lopping any vegetation
  • Buildings and works that may affect identified environmental values
  • Subdivision of land
VPO

Vegetation Protection Overlay

Clause 42.02

Protects significant vegetation including native vegetation and significant trees. Specifies requirements for removing or managing vegetation.

When you may need a planning permit:

  • Removing, destroying, or lopping native vegetation
  • Removing trees above specified size thresholds
  • Works within the tree protection zone of a significant tree
SLO

Significant Landscape Overlay

Clause 42.03

Protects landscapes of significance including those with natural, cultural, or visual values. Common in hillside areas and scenic corridors.

When you may need a planning permit:

  • Constructing or carrying out works
  • Removing, destroying, or lopping vegetation
  • Earthworks and land form changes
  • Buildings visible from identified viewpoints

Land Management Overlays

Clause 44

These overlays manage risks associated with the physical characteristics of the land, including flooding, bushfire, erosion, and contamination.

BMO

Bushfire Management Overlay

Clause 44.06

Applies to land identified as being at risk of bushfire. Requires development to include bushfire protection measures and may restrict vegetation clearing requirements.

When you may need a planning permit:

  • Constructing or carrying out works associated with accommodation or other uses specified in the overlay
  • Subdivision of land
  • Must demonstrate that bushfire risk can be managed to an acceptable level
  • May require a Bushfire Management Statement or Plan
  • Vegetation clearing for defendable space may be required
FO

Floodway Overlay

Clause 44.03

Identifies land in the floodway of a waterway — the area carrying the main flood flow. Development is heavily restricted in these areas.

When you may need a planning permit:

  • Constructing or carrying out works
  • Subdivision of land
  • Referral to Melbourne Water or relevant floodplain management authority required
  • Floor levels and flood proofing requirements apply
LSIO

Land Subject to Inundation Overlay

Clause 44.04

Identifies land affected by flooding but outside the main floodway. Less restrictive than the Floodway Overlay but still requires flood risk to be managed.

When you may need a planning permit:

  • Constructing or carrying out works
  • Subdivision of land
  • Referral to floodplain management authority
  • Minimum floor level requirements typically apply
SBO

Special Building Overlay

Clause 44.05

Identifies land prone to overland flooding from the urban drainage system, rather than riverine flooding.

When you may need a planning permit:

  • Constructing or carrying out works
  • Buildings and works must not increase flood risk to neighbouring properties
  • Referral to Melbourne Water typically required
EMO

Erosion Management Overlay

Clause 44.01

Identifies areas where erosion processes may affect land stability and requires development to manage these risks.

When you may need a planning permit:

  • Constructing or carrying out works
  • Subdivision of land
  • May require a geotechnical assessment
SMO

Salinity Management Overlay

Clause 44.02

Identifies areas affected by salinity and requires development to manage the impacts of saline groundwater.

When you may need a planning permit:

  • Constructing or carrying out works
  • Subdivision of land
  • May require salinity management measures
BAO

Buffer Area Overlay

Clause 44.08

Identifies land near industrial or other uses that may produce off-site amenity impacts requiring buffering.

When you may need a planning permit:

  • Constructing or carrying out works for sensitive uses
  • Assessment of potential amenity impacts from nearby industrial or other uses

Other Overlays

Clause 45

Additional overlays that address specific planning considerations including public acquisition, airports, contamination, and parking.

PAO

Public Acquisition Overlay

Clause 45.01

Identifies land proposed to be acquired by a public authority for a public purpose (such as road widening or park creation).

When you may need a planning permit:

  • Any use or development of land must be referred to the acquiring authority
  • The acquiring authority can refuse consent, preventing a permit from being issued
  • May affect property value and development potential
EAO

Environmental Audit Overlay

Clause 45.03

Identifies land where a preliminary risk screen, environmental audit, or environmental assessment is required before sensitive uses can commence.

When you may need a planning permit:

  • Before a sensitive use commences (residential, childcare, primary school, etc.)
  • Environmental audit or preliminary risk screen assessment required
  • Common on former industrial or contaminated land

Airport Environs Overlay

Clause 45.02

Controls development near airports to manage aircraft noise impacts on sensitive uses.

When you may need a planning permit:

  • Construction of dwellings or other noise-sensitive uses
  • May require noise attenuation measures
  • Referral to airport operator required
PO

Parking Overlay

Clause 45.09

Varies the standard car parking rates in Clause 52.06 for a specific area. May increase or decrease parking requirements.

When you may need a planning permit:

  • Modifies standard car parking requirements for the affected area
  • May reduce or increase the number of car spaces required
  • Common in activity centres with parking precinct plans
SCO

Specific Controls Overlay

Clause 45.12

Applies specific controls to a site through an incorporated document that overrides other provisions of the planning scheme.

When you may need a planning permit:

  • As specified in the relevant incorporated document
  • May override zone and other overlay requirements
  • Commonly used for major development sites with bespoke planning controls
