Subject land: 5 Sample Court, Sandy Bay TAS 7005
Proposal: Demolition and construction of two multiple dwellings over two storeys with associated access and parking.
I make this representation under the Land Use Planning and Approvals Act 1993. I am the owner of the adjoining property at 7 Sample Court, Sandy Bay, and I object to the application, assessed against the Tasmanian Planning Scheme — Hobart, on the grounds below.
Grounds of representation
1. Residential character — General Residential Zone
The land is within the General Residential Zone. The two-storey multiple-dwelling form, with reduced setbacks and increased site coverage, is not compatible with the established single-dwelling residential character the zone purpose seeks to maintain, and does not satisfy the relevant local area objectives.
2. Building height and setback (Acceptable Solutions)
The building height and side/rear boundary setbacks shown on the plans do not meet the Acceptable Solutions of the General Residential Zone (Clauses relating to building envelope and setbacks). Reliance on the Performance Criteria is not adequately justified, and the resulting scale is visually dominant when viewed from my property and the street.
3. Privacy and overlooking
Upper-level windows and the elevated deck provide direct overlooking of my private open space and habitable-room windows within the separation distances in the scheme. No screening or offset is shown, contrary to the privacy Acceptable Solution.
4. Sunlight and private open space
The height and southern siting of the development will overshadow my north-facing private open space beyond the scheme threshold, and the private open space provided to the new dwellings is below the required area and minimum dimensions to serve the living areas.
5. Access, parking and local codes
The shared access to Sample Court, a narrow no-through road, and the on-site parking provision should be confirmed against the Parking and Access Code, including safe sight distance and vehicles being able to enter and exit in a forward direction. Any applicable code (e.g. Natural Assets / Landslip) should also be addressed.
Requested outcome
I ask that Council refuse the application, or require amendment to meet the height, setback, privacy and sunlight standards and the access requirements. I wish to be notified of the decision and note my right to appeal to the Tasmanian Civil and Administrative Tribunal (TASCAT).
