For this Insight the customer uploaded their Certificate of Title (with the registered easements and encumbrances) and their SAPPA property report under the Planning and Design Code, so it goes well beyond the free Property Snapshot: it reads what burdens the title and the precise extent of each overlay. What your title reveals — the free snapshot cannot see this

  • Encumbrance (instrument redacted): a registered encumbrance limits the allotment to one dwelling and controls external design and materials (a developer encumbrance, common on SA titles). It binds you as owner — so a second dwelling or ancillary accommodation is constrained on the title even where the Code would accept one, and your design must satisfy the encumbrance.
  • Right-of-way & drainage easement (instrument redacted): an easement burdens the rear of the allotment in favour of the adjoining land and SA Water for drainage. You cannot build over it and consent is required for works near it, so the rear strip is unavailable for the building footprint.
  • Land Management Agreement (instrument redacted): an agreement registered under the PDI Act requires stormwater and landscaping measures to be maintained. It runs with the land and the council will enforce it through any new consent.

Overlays — and why the precise extent matters

Hazards (Flooding) Overlay — partial: here is where the deeper read pays for itself. The free snapshot only reports the allotment as within the Hazards (Flooding) Overlay. Reading the SAPPA overlay layers against the title plan, the overlay covers only the rear ~25% of the allotment along the low boundary — the front, where the dwelling would sit, is outside it. So flooding mainly sets a minimum finished-floor level and limits fill at the rear, rather than constraining the dwelling envelope.

Zone & assessment pathway

General Neighbourhood Zone: a detached dwelling can be deemed-to-satisfy where it meets every DTS criterion — BUT the Historic Area Overlay removes the DTS pathway and makes the dwelling performance assessed against the Code’s performance outcomes. The buildable area is then driven by the Code and the easement and encumbrance, which bind regardless of the Code.

Why the deeper analysis matters here

A free snapshot would not have told you the encumbrance limits dwellings and controls design, that the rear easement removes part of the buildable area, or that a Land Management Agreement imposes ongoing obligations. It would also have treated the whole allotment as flood-affected. With the title and the SAPPA report read together, the real picture is clear: one performance-assessed dwelling, sited forward of the rear easement and the flooding overlay, designed for the Historic Area and satisfying the encumbrance.
