Subject land: 22 Sample Terrace, Prospect SA 5082
Proposal: Demolition of the existing dwelling and construction of two two-storey dwellings (a residential land division and dwellings).
I make this representation under the Planning, Development and Infrastructure Act 2016. I own and occupy the adjoining property at 24 Sample Terrace, Prospect, and I oppose the application on the grounds below, assessed against the Planning and Design Code.
Grounds of representation
1. Neighbourhood character — Established Neighbourhood Zone
The land is within the Established Neighbourhood Zone, whose desired character protects the single-storey, generously set-back streetscape and established canopy trees. The proposed pair of two-storey dwellings with reduced setbacks does not reflect the Desired Outcomes or Performance Outcomes for character in the zone.
2. Building height and setback (Technical and Numeric Variations)
The site carries a Building Height (Levels) and setback Technical and Numeric Variation. The advertised drawings show a wall height and street/side setback that do not meet the deemed-to-satisfy criteria, producing a form that is taller and closer to the boundary than the TNV contemplates. No adequate performance-based justification is provided.
3. Visual privacy and overlooking (General Development Policies)
Upper-level habitable-room windows and the rear balcony overlook the private open space and habitable rooms of my dwelling. The plans do not show obscure glazing, 1.5-metre sill heights or 1.7-metre screening as the visual-privacy policy requires, resulting in an unreasonable loss of privacy.
4. Overshadowing and private open space
The height and orientation of the southern dwelling will overshadow my north-facing private open space and living-room windows beyond the policy threshold at the September equinox, and the on-site private open space provided to the new dwellings is below the minimum dimensions and area.
5. Regulated / significant trees and stormwater
The development footprint and driveway encroach on the structural root zone of a regulated tree on or near the boundary, and the application should confirm on-site stormwater detention so that additional hardstand does not increase flows onto my land.
Requested outcome
I ask that the relevant authority refuse the application, or amend it to meet the height, setback, privacy and overshadowing policies and to protect the regulated tree. I wish to be heard by the assessment panel in support of this representation and to be notified of the decision.
