Subject land: 15 Sample Road, Bulimba QLD 4171
Proposal: Material change of use and building work — demolition of a pre-1947 dwelling and construction of a multiple-dwelling development (three units) over two storeys.
This is a properly made submission under the Planning Act 2016. I am the owner-occupier of the adjoining property at 17 Sample Road, Bulimba, and I object to the application on the grounds set out below.
Grounds of submission
1. Traditional building character overlay (Brisbane City Plan 2014)
The site is affected by the Traditional building character overlay. The existing dwelling appears to have been constructed in or before 1946 and contributes to the traditional character of the street. Its demolition conflicts with the overlay code’s purpose and the Traditional building character (demolition) overlay code, and the application has not demonstrated that the building does not contribute to the streetscape.
2. Building height and scale (Low density / Character residential zone code)
The two-storey multiple-dwelling form is inconsistent with the intended scale of the zone, which anticipates dwelling houses. The height, bulk and site cover exceed the acceptable outcomes and are not consistent with the performance outcomes for building height and residential density in the zone code.
3. Boundary setbacks and site cover (Dwelling house / Multiple dwelling code)
The side and rear boundary setbacks fall short of the acceptable outcomes, and the resulting site cover reduces deep planting and on-site amenity. This produces an overbearing built edge to my boundary and does not meet the relevant performance outcomes.
4. Amenity — privacy and overlooking
Upper-level balconies and habitable-room windows overlook the private open space and habitable rooms of my property. No adequate screening, offset or sill treatment is shown, contrary to the amenity performance outcomes of the code.
5. On-site parking, access and stormwater
Three units generate parking and vehicle-movement demand that the on-site provision and the single crossover to Sample Road do not adequately accommodate. The application should also confirm that lawful points of stormwater discharge are provided without worsening flows to adjoining land.
Requested outcome
For these reasons I ask that Council refuse the application, or condition it to retain the character dwelling and reduce the scale, setbacks and overlooking impacts. As a submitter, I ask to be advised of the decision and note my appeal rights to the Planning and Environment Court.
