What is a current South Australian title search?
A current SA title search is an official copy of the Certificate of Title from Land Services SA. It shows the current registered owners, encumbrances, caveats, mortgages, and any other interests registered on the title. It's required for most South Australian development applications and must usually be less than 3 months old at the time of lodgement.
What's the difference between a Title, a Plan and a Dealing?
Title (Certificate of Title) — the current ownership record, showing registered owners, mortgages, caveats and any encumbrances. Filed Plan — the registered survey plan showing allotment boundaries, dimensions and easements. Dealing (instrument) — a registered document like a covenant, encumbrance, easement or Land Management Agreement that's referenced on the title. For most SA development applications you need at minimum the Title + Plan; dealings are required if the title references them and they affect the development.
What is an encumbrance under SA law?
In South Australia, 'encumbrance' is used broadly to refer to a registered burden on the title — including covenants, Land Management Agreements (LMAs), restrictions on use, and similar instruments. We can retrieve copies of any encumbrance referenced on the title.
