NSW Section 8.2 Review of Determination

Reasons for refusal addressed
Each numbered reason for refusal addressed line-by-line — misapplied policy, insufficient evidence, unreasonable judgement, site-specific factor.
New information accepted
The reviewer can consider information not before the original decision-maker (s 8.2(5)). Submission flags what's new + why it changes the picture.
Strategic context
Council LSPS, region plan, housing supply targets, comparable approvals — the strategic + fairness arguments that sway reviewers.
Who this is for
DA refused

Frequently asked questions
What's the deadline for lodging a review?
6 months from the date council determined your DA. Don't accept this work outside that window — by then, the only pathway is a fresh DA or a Class 1 LEC appeal.
Is this a substitute for an LEC appeal?
It can be — if the review succeeds you don't need to appeal. If it doesn't, you can still lodge a Class 1 LEC appeal within 12 months of the original determination (the review doesn't pause the appeal clock, so lodge a protective LEC notice if you're approaching the cut-off).
What is a Statement of Environmental Effects?
Every NSW Development Application needs a SEE — the document that walks council through how the proposal addresses the section 4.15 considerations of the EP&A Act 1979. It's the document council reads first.
Can I lodge a DA with this SEE?
Our consumer-tier SEEs are prepared and signed by Town Planning Online Pty Ltd. Most NSW councils accept these for residential and small commercial DAs. For higher-stakes lodgements (apartment RFBs, contested sites, heritage), we recommend the Application-Grade tier where a registered planner reviews and approves before delivery.
Do you cover all NSW councils?
Yes — every NSW LEP + DCP is reachable through the same framework. The AI grounds the assessment in your specific council's LEP development standards and DCP controls.
